Environmental Site Assessment (ESA)

An Environmental Site Assessment (ESA) is a due diligence investigation into whether a property has been contaminated by hazardous substances, typically commissioned by a buyer prior to acquiring real property — either as a standalone asset or as part of a business that owns or occupies land. ESAs follow a two-phase process established by the Canadian Standards Association (CSA Z768 for Phase I; CSA Z769 for Phase II).

A Phase I ESA is a records and visual review conducted by a qualified environmental professional. It examines the property's historical uses, reviews available regulatory records (fire department records, spill reports, regulatory databases), and identifies recognized environmental conditions (RECs) — areas of concern that may warrant further investigation. A Phase I ESA does not involve any soil or groundwater testing; it is an assessment of risk based on documentary evidence and site observation. Phase I ESAs typically cost $1,500–$5,000 and take two to four weeks to complete.

A Phase II ESA is triggered when a Phase I identifies RECs that require confirmation. It involves physical sampling — soil, groundwater, or building materials (for asbestos, lead paint, etc.) — to determine whether contamination is actually present and, if so, at what levels relative to regulatory standards. Phase II ESAs cost $5,000–$50,000 or more depending on scope and the number of samples required. If contamination is confirmed, a Phase II will typically be followed by remediation planning and, ultimately, a Record of Site Condition filed with the provincial regulator. Environmental liability in real property transactions can be significant, and buyers acquiring property with known contamination must carefully allocate that risk in the purchase agreement.
